The date of the Tempi trial is λέει to be announced as early as this week, following the rejection of motions by Appeals Court president Maria Lianou, according to a report in Kathimerini. Thirty-six defendants will be tried, including officials from OSE, ERGOSE, Hellenic Train, the Regulatory Authority for Railways and the Transport Ministry. Thirty-three of them will face felony charges.
She dismissed requests for the case file to be returned to the investigating judge for additional action, saying the investigation had been completed properly. She also rejected a request for the fire-resistance of train cars and seats to be re-examined, noting that the specifications had been met.
In addition, she denied a petition by Maria Karystianou seeking further indictments, agreeing with investigating judge Sotiris Bakaimis that contract extensions were the sole responsibility of ERGOSE employees.
The exhumation to determine the cause of Denis Routsis’ death is the key demand of Panos Routsis, who has been on hunger strike for two weeks.
On the issue of exhumations, she referred requests for DNA identification to the Larissa Court of First Instance, where a new case file could be opened if crimes are suspected during the handover of the victims’ remains.
However, she stressed that forensic reports are sufficient to determine the causes of death of the burned victims and ruled out exhumations to test for substances, as no evidence of suspicious cargo emerged during the inquiry.
She added that the conclusions of independent technical experts for the families cannot override the findings of official specialists. Finally, she noted that the court may order new investigative steps if needed, while warning that delays could risk the statute of limitations on misdemeanor charges.
